The following terms and conditions including all documents referred to (“Conditions”) outline the way how CashGo operates, including but not limited to the services we offer and details of payments and transfers, data protection and, website use.

The following terms shall have the meanings defined below for the purposes of these Terms and Conditions:

  • “CG Online Service System” refers to the services that is provided by CashGo which includes is Top Up service and Send Money service through CG Website.
  • “Website” refers to the website which We operates to provide online send money transfer services; and
  • “CG”, “We”, “Our”, or “Us” refers to CashGo.
  • “Credit” refers to the available money that allowed to enable ClientUser to performs any actions such as like Top Up, Internal Transfer and Send Money in CG Online Services.
  • “Internal Transfer” refers to the service that a ClientUser uses to transfer the wallet amountWallet Credit to another ClientUser through the CG Online Service.
  • “Receiver Method” refers to the options available to the Sender select for the Receiver’s receive method, which may include Bank Account and Mobile Wallet.
  • “Receiver” refers to the person named as the beneficiary of the Send Money order.
  • “Send Money” refers to the service that a used by ClientUser uses use to send money from Malaysia to other countries through the CG Online Service.
  • “Sender” refers to the person who initiated a Send Money order through the CG Online Service.
  • “Top Up Method” refers to the options available to the ClientUser to Top Up wallet amountWallet Credit through CG Online Service either via direct, which may include Online Banking or a Bank Account deposit.
  • “Top Up” refers to the service that ClientUser uses to increase the Wallet Credit wallet amount through CG Online Service.
  • “Transaction” refers to every money transaction that You the User initiates through the CG Online Service.
  • “Wallet” refers to the place that store the Credit amount value of the ClientUser.
  • “You”, “Yours”, or “Your” refers to every and any person anyone using the CG Website as a Sender.

The parties to this agreement are CashGo (“CG”), and the User(s) who has/have either completed the registration form and/or agreed to these conditions electronically (the “User”) and shall apply to all use by the User’s account with CG, whether through the CG Online System or otherwise.

These Terms and Conditions shall be governed by and construed in accordance with Malaysian Laws, and the parties hereby submit to the jurisdiction of Malaysian courts and you waive any right to object proceedings being conducted in such courts.

OUR SERVICES

a. CG offers to all its Users a full range of services including Top Up, Internal Transfer and Send Money services. Users must be at least 18 years old to use CG Online Service. Each User must complete an identity verification process before given the full access in CG Online Service.

b. Top Up Services

  • CG offers Top Up services in the app to allow Users to Top Up their Wallet Credit. Each Top Up transaction is given an individual transaction tracking number which will allows the User to track and trace all Top Up transaction history and statuses.
  • CG Online System shall provide the User with two Top Up Methods to choose from (a) direct “Online Banking” method in which the Top Up amount shall be credited in to the User’s Wallet within 15 minutes; or (b) Bank Account deposit in which the Top Up amount shall be credited to the User’s Wallet within 3 business days.

c. Internal Transfer Services

  • CG offers Internal Transfer services for Users to transfer Wallet Credit to another User or Agent. The Wallet Credit will be deducted directly once the Transaction is completed successfully. Each Internal Transfer transaction is given an individual transaction tracking number which allow the User to track and trace all Internal Transfer transaction history and statuses.

d. Send Money Services

  • CG offers Send Money services locally and internationally. Each transaction is given an individual transaction tracking number which will allow the User to track and trace all Send Money transaction history and statuses.
  • The Sender shall instruct CG to execute a specific Send Money order by providing CG the required information and by accepting all Terms and Conditions. Each Send Money order constitutes a separate agreement between CG and Sender and is limited to the execution of the specified Send Money order only. Instructions for each subsequent Send Money order shall be raised by the Sender and CG shall only act upon the instructions of the Sender. The Sender shall immediately inform the Receiver of the Send Money order once the instruction is made.
  • The money is available for collection by the Receiver at the end of such day on which the money was received (“Day of Receipt”). The moment of receipt is when We receive the money to be transferred and the fees associated with the transfer. Bank Account transfers generally take up to 3 business days to be completed, whereas Internal Transfers shall be completed within 15 minutes.

e. The CG Online Service provides various options for the receiving of money, including direct wire transfer bank deposits or Wallet deposits, where applicable. For bank account or Wallet transactions, CG will transfer the money to the account information as provided by the Sender. In the event of an inconsistency between the account number holder (including mobile phone numbers for mobile phone accounts) and the intended Receiver’s name, the transfer shall be credited to the account number provided by the Sender.

WALLET

a. When a User performs any transaction through the CG Online system, the value stored in the Wallet shall always act as Credit.

b. The Credit can only be used for services and/ or Transactions provided by CG Online System. CG reserves the right to terminate a User account in the CG Online system without notice if it is found to be in violation of these Terms and Conditions. All decisions made by CG shall be final and conclusive.

OUR RESPONSIBILITY TO YOU

a. We declare Our willingness to provide You with Money Transfer services and related information in accordance with these Terms and Conditions in the form of individual payments and to exercise reasonable care.

b. Disclaimer of responsibility. CG shall not be responsible for the followings:

  • Goods or services purchased through CG Online System including their delivery;
  • Failure in communication facilities over which CG has no control;
  • Data loss or the transmission delay caused by using an Internet service provider, a browser or other software over which CG has no control whatsoever;
  • Viruses originating from third parties;
  • Unauthorised use or interception of information prior to reaching CG Website
  • Unauthorised use or access to data in conjunction with the User’s Transaction provided always CG is at no fault for such use or access.

c. CG shall not be obligated to effect or execute a Send Money Transaction if:

  • CG is unable to obtain sufficient evidence to verify the User’s identity;
  • CG has reasons to believe that the Transaction information is suspicious, inaccurate, unauthorised, or forged; or
  • User has provided CG with incorrect or incomplete information; or
  • User had failed to provide CG with the Transaction information in a timely manner to ensure the timely execution of the requested money transfer.

YOUR RESPONSIBILITY TOWARDS US

a. You agree and undertake to pay CG Our fees in accordance to clause 2 for every Send Money order initiate via the CG Online System.

b. You shall ensure at all times to have sufficient Wallet Credit to settle the amount stipulated on the Send Money order together with CG platform charges. You are required to Top Up the credit value either by way of direct Online Banking or Bank Account deposit if Your Wallet has insufficient Credit to effect the Transaction.

c. You consent to and acknowledge the following:

  • The information provided to complete a Send Money order are true, accurate, and complete;
  • You shall provide and furnish all further supporting documents and information at CG’s request;
  • A receipt of Transaction shall be generated containing, Your name, phone number, name of receiver and transaction tracking number for each Transaction. The receipt of Transaction shall only be shared to the Receiver and you are obligated to ensure that no third party can gain unauthorized access to this information. We recommend that You only send money to beneficiaries that You know personally;
  • You shall not provide false, inaccurate or misleading information;
  • You shall not use any anonymizing tool in the attempt to conceal Your transactions or make Your activities untraceable;
  • You shall not use the CG Online System for any illegal or prohibited purposes which shall contravene any applicable laws, rules, regulations, directives and/or orders;
  • You will not initiate any money transfer Within the framework of the CG Online System that violate these Terms and Conditions or any other restrictions of use or terms of use as set forth on the CG Website; and
  • You are personally responsible for keeping Your password and Your username secure, pursuant to clause 7 below.

d. In the event the Transaction data is breached, lost, stolen, copied, misused or compromised, You shall immediately notify CG. You will be liable to Us for damages resulting from the improper use of the Transaction data id You have passed such information to anyone other than the Receiver of the money payment or if You have facilitated the improper use of the payment instrument or with gross negligence. You shall notify Us if You become aware of a Transaction which You did not authorise or which was executed erroneously.

e. You agree to and acknowledge that We may forward any information about You and/ or the Receiver and information about the services that We have provided to any regulatory and/ or government authorities or their bodies if:

  • We are obligated by law to do so; or
  • We believe that such a disclosure may assist in the prevention of fraud, money laundering or other crimes.

f. It is Your responsibility to ensure all details are accurate before You submit a Transaction request. You will have the opportunity to review and confirm all Transaction details before submission of a Transaction. Once a Transaction request has been submitted, You are not allowed to amend details of that request. We shall not be held responsible for any errors or mistakes in the details submitted by You.

CUSTOMER SERVICE

If You notice any errors or encounter any problems with the CG Website or with the CG Online System, please inform Us immediately by contacting our live support or by sending an email to

PASSWORD AND SECURITY

Users must first create an account in the CG Online System before the User may use the services provided by CG. During the account registration, Users will be asked to provide a username, a password, and a valid phone number. Users shall keep the password and the username private and confidential and must not share the details with anyone else. When you first log in, You will be required to set a secure pin. It is Your responsibility to keep Your secure pin and all Transactions carried out in CG Online System secure. You agree to notify Us immediately of any unusual transactions, We shall take all the necessary steps to prevent any further use of such information. Prompting these steps do not make Us liable for any loss or damage caused by Your failure to comply with Your duty in accordance with this paragraph.

DISCLOSING INFORMATION TO THIRD PARTIES

CG will use and process your personal information as described in Our Privacy Statement and you explicitly consent thereto. Click here for Our Privacy Statement. We reserved the right to amend Our Privacy Statement at any time.

LIABILITY

a. We are responsible to You for the proper execution of the services that provided by CG Online System in accordance with these Terms and Conditions. If a Transaction had failed, We shall fully refund the amount of the Transaction and all CG platform charges (if any) plus default interest. If You did not authorise a Send Money order, We shall refund the amount of the Transaction and CG – platform charges (if any) provided always that You did not disclose the Transaction details to any third party pursuant and had immediately informed Us as soon as You learned of the breached, lost, stolen, copied, misused or compromised of the Transaction data in respect of the unauthorised or failed execution of a Send Money order.

b. Every claim for damages which You assert must be supported by available and relevant documentation.

c. Subject to applicable law, We shall not assume liability for any damage caused by unusual and unforeseeable events over which CG has no control and the consequences, of which CG could not have avoided despite exercising due care (caused, for example by Force Majeure, failure of telecommunication lines, civil unrest, war or other events such as industrial action or lockouts over which We have no control).

d. CG does not guarantee the delivery or suitability of any goods or services purchased with CG send money. The Sender’s Transaction data is confidential to him/her and should not be shared with anyone other than the Receiver. The Sender is advised not to send money to anyone he does not know. CG will not be liable if the Sender communicates Transactional data to anyone other than the Receiver. In any event, subject to applicable law, CG shall not be liable for any indirect, special, incidental, or consequential damages.

e. Notwithstanding anything contained herein, if You are a Consumer under the Consumer Protection Act 1999 (“CPA”):

  • CG provides You with any implied warranties under the CPA that cannot be excluded by the CPA
  • these Terms and Conditions are intended to exclude or limit Your rights and remedies to the greatest extent permitted by law and the CPA; and
  • nothing in these Terms and Conditions is intended to exclude or limit CG’s liability to You for any loss or damage arising from
    • CG’s; or
    • breach of any express terms contained herein or implied by the CPA which cannot be excluded without adequate justification.

LINKS TO OTHER WEBSITES

The CG Website may contain links and pointers to other World Wide Web Internet sites and resources (collectively referred to as “Linked Sites”). Links to any Linked Site do not constitute Our endorsement with any third-party resources or their content. Links do not imply that CG is associated with third-parties or has the legal rights to use any of CG’s trademarks, trade name, logos, or copyright symbols. You should direct any concerns regarding any Linked Site to the administration of that respective any Linked Site. You hereby acknowledge that reliance upon any opinion, advice, or information displayed on or otherwise available through any Linked Site shall be at Your own risk.

ENTIRE AGREEMENT

These Terms and Conditions, jointly with all other contractual items referred to in these Terms and Conditions, constitute the entire agreement between You and Us and supersede any prior agreements which may exist between You and Us.

SEVERABILITY CLAUSE

If one or more of these Terms and Conditions are found to be invalid, unlawful, or unenforceable, this does not affect the validity of the remaining provisions.

COMPLAINTS, APPLICABLE LAW, JURISDICTION
